Due to the nicotine content found in eggplant, green tomatoes and potatoes they could be subject to regulation under the Tobacco Control Act by the final rule published May 10, 2016. These regulations will require farmers to now submit a PMTA (Premarket Tobacco Application ) in order to grow, farm, and sell any of the newly deemed products listed above. Many have applauded these regulations and the FDA for attempting to know what is ultimately good for our health better than the people it’s supposed to be serving.
On May 10, 2016 the FDA published their final rule on regulating the electronic cigarette industry including vape juice. Although, we must applaud their efforts on such things as requiring products to have child safety closures, requesting age verification and disclosure of ingredients. We must note, the majority of the vape juice industry had already begun implementing these protocols long ago. A pioneering example of free market and self regulation, the vape industry set forth to align their needs alongside the needs of the customer. However despite this remarkable feat, a further read into the 499 pages of the official rules reveals a much more draconian nightmare for everyone involved. Simply put, these regulations will cripple the vape industry and force thousands of small business to shut down due to the onerous regulations, dealing a major blow to the US economy and leaving millions of lives at risk by denying access to products.
