Due to the nicotine content found in eggplant, green tomatoes and potatoes they could be subject to regulation under the Tobacco Control Act by the final rule published May 10, 2016. These regulations will require farmers to now submit a PMTA (Premarket Tobacco Application ) in order to grow, farm, and sell any of the newly deemed products listed above. Many have applauded these regulations and the FDA for attempting to know what is ultimately good for our health better than the people it’s supposed to be serving.
On May 10, 2016 the FDA published their final rule on regulating the electronic cigarette industry including vape juice. Although, we must applaud their efforts on such things as requiring products to have child safety closures, requesting age verification and disclosure of ingredients. We must note, the majority of the vape juice industry had already begun implementing these protocols long ago. A pioneering example of free market and self regulation, the vape industry set forth to align their needs alongside the needs of the customer. However despite this remarkable feat, a further read into the 499 pages of the official rules reveals a much more draconian nightmare for everyone involved. Simply put, these regulations will cripple the vape industry and force thousands of small business to shut down due to the onerous regulations, dealing a major blow to the US economy and leaving millions of lives at risk by denying access to products.

The Right to be Smoke-Free Coalition is a non-profit, industry-led trade association dedicated to promoting the interests of the vapor industry by advocating for reasonable and responsible laws and regulations.

The Cole-Bishop Amendment – On April 19, 2016, the House Appropriations Committee voted to include a bipartisan amendment, sponsored by Rep. Tom Cole (R – OK) and Rep. Sanford Bishop (D – GA), to the 2017 fiscal year Agricultural Appropriations bill that would amend the February 15, 2007 “grandfather date” and would allow products already on the market to stay on the market without subjecting them to the PMTA. A vote over the bill could take place in the next few weeks.

HR2058 – Introduced by Representative Tom Cole of Oklahoma on April 15, 2015 this bill would amend and change the grandfather date of February 15, 2007 and would allow products already on the market to stay on the market without subjecting them to the PMTA. Once your informed it’s time to get active and get the word to everyone you know! This includes going to local vapor shops, asking friends and family to reach out to state representatives, making videos, posting ideas on social media. This is a time to showcase your brilliant side and get creative. The goal is inform people of the facts while helping the public realize what a health tragedy this could be.
Spread the word about vaping and how it has helped you and your family. Write letters to newspaper editors, share on social media platforms, call into your radio stations, write a song, rent a billboard on a busy street if you can, or any other positive idea that has the potential to reach people. If you know a friend, family member or work colleague who smokes help them break their habit after all you have already been down that road. The more smokers we can convert the more we lead a unified front on the vaping evolution.

The American Heart Association, American Lung Association, American Cancer Society, and Campaign For Tobacco Free Kids have ALL rejected actual science based facts and promote fear based legislation. Why? Contact these groups and ask them with all the donations they receive every year, why they have not one single peer reviewed study published on Ecigs? Surely they would be interested in doing this after all they want to help right? Let them know you will no longer show support both financially and voluntarily until they can help be a part of the solution.
Call your congressmen or congresswomen immediately! Schedule an appointment to see them and ask them where they stand on supporting vaping and vaping related legislation such as HR2058 and the Cole-Bishop Amendment, both bills should be supported.
